Each party may pursue injunctive or equitable relief from any court. For all purposes, parties consent to exclusive jurisdiction and venue in Delaware state or federal courts or the U.S. District Court for the District of Delaware.

Arbitration occurs on an individual basis; class arbitrations and class actions are not permitted. Both parties waive the right to trial by jury or class action participation.

The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded. Claims must be brought within one year of the cause of action arising.
